In 2001, Australia’s government passed an Interactive Gambling Act which prohibited the advertising of gambling services and online casinos on websites “where it is likely that the majority of that site’s users are physically present in Australia itself”. Sites that are found to have committed a breach of the Act may be fined up to $220,000 (in Australian currency) per day – per day – if the site is run by an individual, and if the search engine or site is run by a corporation the fine can run as high as $1.1 million (Australian) a day.

Thus many did not find it too surprising that when a recent investigation began into online casinos advertising in Australia, Google Australia was the subject of focus by authorities carrying out that online casinos ad investigation. According to a spokesperson in the Australian capital, Canberra, “Google Australia displays advertising links to online casinos sites when certain keywords are purposely misspelled. As a result, the investigators of the Department of Communications, Information, Technology and the Arts are looking into possible illegal practices carried out by Google Australia related to the Interactive Gambling Act of 2001 related to online casinos gambling advertisements.”

While Google Australia is a big name subject of the online casinos investigation being carried out by the Australian government, a little-known Melbourne, Australia-based search engine company known as Web Wombat has recently admitted to engaging in actions which would constitute direct, deliberate violations of the Interactive Gambling Act of 2001. The recent investigation into online casinos and general online gambling advertising in Australia demonstrates that the debate over the legality or illegality of online casinos gambling is not relegated simply to North America, particularly the United States, alone.
